General

The General Terms and Conditions apply automatically from the time of the agreement with the owner. 

Duties of "The Barking Butler"

"The Barking Butler" reserves the right to exclude dog owners and their dogs from training if the animal is treated in a psychologically or physically aversive manner. "The Barking Butler" works without any aversive aids, without strong language and always for the benefit of the animal.

"The Barking Butler" reserves the right to cancel appointments in urgent cases. In these cases, the booked service will be rescheduled with the client.

"The Barking Butler" reserves the right to cancel the training at its own discretion. In such cases, the tuition fee will be refunded on a pro rata basis. This reservation may come into effect, for example, if important information for the training (e.g. misbehaviour of the dog) is concealed from "The Barking Butler".

"The Barking Butler" works according to the latest knowledge and with the greatest care. However, training success can never be guaranteed, as this depends on various factors.

"The Barking Butler" pays attention to considerate treatment of nature. "The Barking Butler" is also very important the peaceful interaction with other people and animals.

"The Barking Butler" is committed to training the dogs and their owners to the best of our ability and making the coaching experience as enjoyable as possible. 

If a dog is not in therapy with "The Barking Butler" because of behavioural problems, there is a legal obligation to report aggressive dogs to the responsible veterinary office in accordance with the Federal Animal Welfare Act.

"The Barking Butler" accepts no liability for a dog falling ill or for damage as a result of illness, bite injuries, accident or elopement, or for the loss of the dog, unless gross negligence or willful misconduct can be proven. 

If an accident or damage to property occurs to third parties, "The Barking Butler" is only liable in the case of a proven breach of duty of supervision or gross negligence. 

"The Barking Butler" has personal and professional liability insurance. 

Duties of the Owner

The dog must be free of infectious and other contagious diseases. 

The owner is obliged to inform "The Barking Butler" about health problems, allergies or other abnormalities (e.g. heat, special food requirements etc.) of his dog. In case of concealment or ignorance of an allergy, food intolerances, illness or other restrictions, the dog owner is always liable. "The Barking Butler" disclaims all liability. 

The dog must be chipped and registered with "Amicus". 

The dog must be at least 10 weeks old, in a social environment and able to respond to its name. 

The owner must have personal liability insurance (with coverage for personal injury, property damage, etc. caused by the dog). 

The owner is liable for all costs of damage caused by his dog to other people, animals and objects. In the event of injury to one's own dog due to the dog's own fault, the dog owner shall be liable for the costs incurred. 

Prices and terms of payment

Prices published on "barkingbutler.ch" website apply.  

Payment is made by Twint transaction or in cash against receipt on site. In exceptional cases by bank transfer using IBAN no. within 10 days. No separate invoice will be issued. "The Barking Butler" is entitled to charge a reminder fee of CHF 15.00 per payment reminder, as well as other fees, in particular the costs of any collection procedure.

Booked appointments that are canceled less than 24 hours in advance must be charged. In case of unexcused non-appearance at a booked appointment, it will be charged in full.

Data protection

The customer agrees that personal and factual data will be included in the customer file of "The Barking Butler". In case of emergency, pertinent data may be passed on, e.g. to the veterinarian or similar organizations. 

Validity

The general terms and conditions are effective for all oral and written contracts as well as services between the clientele and "The Barking Butler".

By registering with "The Barking Butler", the customer declares to have read, understood and accepted these terms and conditions. Registration is always binding.

Place of jurisdiction

Swiss law is exclusively applicable to the legal relationship between the customer and "The Barking Butler". 

Place of performance and jurisdiction is exclusively the place of business of "The Barking Butler".
